b. Agreement and adjustment

If you use our website, the applications and if you fill out the contact form you will be asked to agree with the provisions and measures in this privacy policy.
The company reserves the right to change its privacy policy at any time, provided it informs its users about this through the website or by e-mail. The changes will automatically take effect after publication.

The processing of the personal data within the company is subject to the European Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

II. II. Collection of personal data

a. Definition of personal data

All data or information (e.g. name, telephone number, e-mail address, date of birth, etc.) that relate to an identifiable person must be understood under the heading of personal data. Due to the broad formulation, a lot of data can be regarded as personal data.

b. In what way are these personal data collected

If you use our website, various personal data are collected in different ways:

  1. The personal data are communicated by you (through the contact form, etc.) or we obtain them because you use our services (e.g. login module on our website, online profile, agreement, etc.);
  2. The personal data that we assign to you for the use of our services (e.g. formulating a contract, concluding an agreement, etc.).

The different ways of collecting personal data are of course subject to specific provisions and conditions in the privacy legislation. That is why it is important that the differences between the aforementioned ways of collection are explained.

1. The data are communicated by the data subject itself.

Personal identification details such as name, address, email, telephone number are necessary for the use of our online services (the use of the contact form, the use of parts of the website for which registration is required, the determination of the assignment, etc.) and are provided to us by you yourself.

Depending on the service you wish to use, the following categories of personal data may be requested:

  2. Personal details (age, gender, etc.);
  3. Lifestyle (use of goods and services,);
  4. Images (profile photos, etc.);
  5. Assets (land, property or other possessions, etc.).

2. Automatic collection of personal data

These data are completely anonymous and therefore cannot be linked to personal identification data, as a result of which it is not possible for the controller to identify the data subject. Of course, if necessary, your permission for the use of cookies and tracking technology is explicitly requested based on the Telecommunications Act. This happens on the basis of our cookie policy as shown on our website.

c. No processing of sensitive personal data

As prescribed by law, we do not process sensitive data such as racial or ethnic origin, political opinions, religious or philosophical beliefs, sexual preferences, health and trade union membership.

III. Purposes of processing

a. Definition

The processing of personal data collected by us includes any processing relating to the collection, recording, arranging, storing, updating, modifying, retrieving, consulting, using, distributing, making available, bringing together, combining, archiving, erasing and destruction of the data.

b. Purposes

The processing of the aforementioned personal data (e.g. display of the real estate portfolio, presentation of overviews and statistics per property or region, etc.) is necessary to achieve the objectives set by us:

  1. Commercial follow-up. Contact you for our commercial purposes and to inform you about our offer (including property, buildings, land, etc.) based on your preferences.
  2. Direct Marketing. Send our newsletters/ info and match offers to the preferences you have provided in the past. This in order to give you only the news and commercial offers that really interest you or answer your profile.
  3. Market research. Use your data and consumer profile for the research for and of the market situation of our products and services. This way we ensure that we constantly innovate the existing services and launch new brokerage, marketing and advertising services on the market.
  4. Informing the client. Your details as requested when using our services are important for the execution of the assignment. In this way, the company receives an overview of prospects per property and such.
  5. Prepare statistical data. Display the collected data in different overviews, tables and graphs per property, region and / or client to assess and further improve the brokerage, marketing and advertising services.
  6. Advertising. To post and advertise real estate such as houses, apartments, land, company buildings, etc. through various means of communication (portals, websites, social media, etc.).

c. Quality and balance of interests

As the controller we ensure the quality and legality of the personal data collected and processed by us. We take all necessary measures to erase or correct the data that are inaccurate or incomplete.

In the collection and processing of the available personal data, we reserve the right to collect and process the data that serve to achieve our processing purposes. No excessive data nor data that “might as well apply one day” are collected or processed by us.

IV. Storage period data

The personal data are stored for the entire duration that is necessary for the realization of our processing purposes. We do not store your data longer or process them further than necessary for the purposes.

The personal data are stored for a period of 20 years and after then removed or at least anonymised, making identification of the users no longer possible. If the person in question unsubscribes for direct marketing, the personal data will be deleted or anonymized unless they are further necessary for the execution of the assignment.

V. Transfer of personal data

The company transfers personal data to third parties when:

  1. The transfer is necessary for the realization of our purposes, including and as mentioned above (statistical research, promotion within the framework of our assignment and/or publicity of real estate as well as for the use and management of our portfolio). VI. Additional protection minors

The company will make efforts with the available technology to check whether the user does have parental consent.

VII. Rights of the data subject

a. Right to information

According to the legal provisions, the company in its capacity of controller must clearly inform you about the collection and processing of personal data.

This privacy policy therefore also applies as a personal notification.

b. Right of access

You have the right to obtain from the company, as controller, information about whether your personal data are being processed or not. If your personal details have been processed, you can consult your data in our files with additional information about the processing purposes, the categories of personal data, any recipients of your personal data, the storage period, complaints procedure, etc.

You can also request a copy of your personal data, without accompanying administrative costs. Note that when you request several copies, the company will charge a reasonable fee for this.

c. Right to correct

As a data subject, you have the right to correct any incomplete or incorrect personal data relating to yourself.

The term "correct" should be understood as meaning that you can have incorrect data adjusted for free or even have them removed. You can gain access to your personal profile via our website, if this is available, and adjust your registered data at any time. The correctness and quality of your personal data is of great importance for achieving our purposes.

d. Right to object

You have a double right of objection. The legal provisions provide for a general right to objection and an objection regarding direct marketing.

That means that as a user/data subject, you have a general right to object.

General right to object:

You may object to the processing of your personal data if the data are incomplete or irrelevant for the purposes of the processing, or if the data for which registration, communication or storage are prohibited or when the data are stored for longer than the specified duration.

When your personal data are lawfully processed, you can object to this processing in accordance with the legal provisions of the privacy legislation for serious and justified reasons related to your particular situation.

Here, you must demonstrate weighty and justified reasons to prevent further processing.

Right to object to direct marketing:

You can object free of charge and without any justification to the processing of your personal data for direct marketing purposes. The procedure for exercising this right can be consulted under point g.

e. Right to be forgotten

You can have your personal data deleted in your own name without unreasonable delay. This provided that:

  • The personal data are no longer necessary for the purposes for which they were collected or processed;
  • You withdraw the consent given for specific purposes;
  • The personal data have been processed unlawfully;
  • The personal data must be deleted in order to comply with a legal obligation;
  • When it concerns personal data of minors under 16 concerning services provided electronically for a fee.

f. Right to obtain personal data

You have the right to request the company / controller of your personal data to provide you with the data held by the company in a structured, standard and machine-readable form.

This can be requested both for personal use and to pass it on to another controller than the company.

If it is technically possible for us, you can also request the electronic transmission of your personal data to another company.
